Long in force in Quebec, the Pay Equity Act came into force on August 31, 2021. It applies to all federally-regulated private and public sector companies.
Pay equity: comply before September 3, 2024
With three (3) years to comply, companies with 10 or more employees must now produce the final version of their pay equity plan by September 3, 2024. They must then declare it to the Canadian Human Rights Commission. Additional obligations apply to companies with more than 100 employees.
The purpose of this Act is to proactively correct systemic gender discrimination in employers’ compensation practices by producing a pay equity plan to be updated every 5 years. The federal process has many similarities with the Quebec version, but retains its own particularities, particularly with regard to deadlines.
